Welcome to beholdenvisuals.com. By accessing our website, booking media services, or electing to receive communications from us (including SMS notifications), you agree to be bound by the following Terms & Conditions. Please read them carefully.

1. Service Offerings and Delivery

Beholden Visuals provides premium real estate media, including photography, aerial drone coverage, walkthrough videos, social media reels, 3D virtual tours, and schematic floor plans. Our standard service guarantees delivery of photography and floor plan media within 24 hours of the shoot completion, unless otherwise specified. Video edits and virtual staging may require up to 48 hours for processing.

2. Bookings, Cancellations, and Rescheduling

Bookings are made online through our portal or verbally over the phone. We request at least 24 hours' notice for cancellations or rescheduling. Cancellations made less than 24 hours prior to the scheduled shoot time may be subject to a cancellation fee. Weather-related cancellations (e.g., heavy rain or high winds that prevent safe drone flight) will be rescheduled at no additional charge.

3. SMS/MMS Mobile Messaging Terms

Beholden Visuals operates a customer communication messaging program. We send text messages (SMS and MMS) to coordinate listing shoots, provide appointment reminders, send arrival updates, notify you when media deliverables are ready, and communicate transactional billing details.

  • Opt-In Consent: You consent to receive communications by providing your mobile number during online booking, verbally opting in over the phone during scheduling, or signing a written booking request. By doing so, you consent to receive text messages from Beholden Visuals at the number provided. Consent is not a condition of purchase.
  • Rates: Message and data rates may apply. Please check with your mobile carrier for your plan details.
  • Frequency: Message frequency varies depending on your booking status, appointment details, and scheduling updates.
  • Opt-Out (STOP): You can cancel mobile communications at any time. To unsubscribe, reply STOP to any message you receive, call us at (713) 487-7119, or email us at info@beholdenvisuals.com. After replying STOP, we will send you one text message to confirm you have been unsubscribed, and then no further messages will be sent.
  • Assistance (HELP): If you require assistance, reply HELP to any message, email info@beholdenvisuals.com, or call (713) 487-7119.
  • Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

4. Intellectual Property and Licensing

Beholden Visuals retains ownership of all media captured (including photographs, video files, and 3D tours). Upon payment in full, the booking agent is granted a non-transferable, royalty-free license to use the media for the marketing of the specific property listing. This license is valid for the duration of the listing and expires once the property sells, is leased, or is taken off the market. Re-licensing media to third parties (such as builders, stagers, or other agents) is strictly prohibited without written consent.

5. Payment Terms

Invoices are generated upon delivery of the media. All invoices must be paid in full to download high-resolution unwatermarked deliverables. Unpaid balances beyond 30 days are subject to interest and late fees.

6. Limitation of Liability

Beholden Visuals is not liable for any indirect, incidental, or consequential damages resulting from the use of our website or services. Our total liability under any booking is limited to the amount paid for the specific services rendered.

7. Privacy Policy

8. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
